If asked about it, just say that you are using it to be certain that you don't miss anything important. now if the lecturer says anything of that sort again, you have the proof. Then you can either ask him to stop the comments or take your tape and go to student services and file a complaint for emotional abuse. Colleges take abuse complaints very seriously because if a lawsuit is filed, it can cost the college millions.
